Unopposed Divorce
An unopposed divorce is one where both parties agree to end their marriage and further agree on every aspect of their divorce including:
• Which spouse will commence the divorce proceedings,
• The division of joint estate,
• Contact and care of maintenance of minor children.

• Spousal maintenance
Because the parties to the unopposed divorce work collaboratively on all aspects, the process is quick, efficient, predictable, and cost effective. An unopposed divorce appears simple enough to do on your own.
However having an attorney is necessary to ensure that all the legalities are met, and the settlement agreement correctly reflects what the parties want to happen. This also eliminates the need to go back to court to amend a settlement agreement.
Opposed Divorce
Opposed Divorce occurs when both parties do not agree on the terms of how the marriage must be dissolved. These disagreements cause the divorce process to the drawn out, complex and challenging for both parties and expensive because more work needs to be done to finalise the matter. The court is required to make a final decision on the dissolution of the marriage and how the joint estate will be divided because the parties are unable to disagree.
